1. Introduction

Welcome to TakeFlight Digital Ltd (“we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, software platform, digital products, and services provided through www.takeflight.digital (the “Site”), including but not limited to:

By accessing or using our Site or services, or by purchasing any product, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase our products or services. These Terms apply to all users, including customers, visitors, and anyone accessing or interacting with our products and services.

2. Subscriptions, Services and Payments

2.1 Subscription plans

We offer subscription access to our platform under the following plans:

Each plan carries a recurring fee, billed monthly unless otherwise agreed at checkout. Introductory or first-month pricing, where offered, applies only to your first billing cycle, after which the standard recurring fee applies. Your subscription renews automatically unless cancelled in accordance with these Terms.

2.2 Billing and payment processing

Payments are processed securely through our payment processor. By subscribing or purchasing from us, you authorise us (via our payment processor) to charge your chosen payment method on a recurring basis until you cancel. You can manage your billing information and view or download invoices from within your TakeFlight account.

2.3 Cancellations and access

You may cancel your subscription at any time from your billing dashboard or by contacting support@takeflight.digital. Cancellations take effect at the end of your current billing cycle. You retain access to the platform until that cycle ends. No partial refunds are given for mid-cycle cancellations.

2.4 Refund policy

We do not offer refunds on subscription payments. You are responsible for cancelling your plan if you no longer wish to be billed.

Fast Track Account Setup is a done-for-you service that begins on purchase and is non-refundable once purchased. Any other done-for-you or professional services, including the Growth Accelerator service, are likewise non-refundable once work has commenced. Digital downloads are non-refundable due to their immediate-access nature.

2.5 Failed payments and account suspension

If a payment fails, we will notify you and your account may be paused until you update your payment method. Continued non-payment may result in suspension of your account and of access to your data.

2.6 Fast Track Account Setup — scope of service

By purchasing Fast Track Account Setup, you acknowledge and agree that it is a defined, fixed-scope service that configures TakeFlight’s proven system in your account and prepares it for launch, typically within three to five working days. It is a guided setup, not an open-ended custom build.

Fast Track includes: configuration of your account and the platform’s templates, funnels, and automations; branding of the funnels we provide; a brand messaging document; light copywriting for the landing pages and email sequences included in the setup; and an investment guide. Your first month of Base is included.

“Light copywriting” means drafting and adapting copy for the standard set of landing pages and email sequences included in the setup. It does not include unlimited revisions, long-form content, or copy for pages, assets, or campaigns outside that included set.

Fast Track does not include: custom websites or landing pages built outside our provided funnel templates; bespoke automations beyond those included in the setup; connecting your CRM, forms, or automations to external websites you have built; or ongoing training or done-for-you changes beyond the onboarding and the technical support period. Anything outside the agreed scope would require a separate quote.

Technical support for your Fast Track setup is included for [CONFIRM: e.g. 7] days following completion, covering technical adjustments to what we delivered. It does not include training, strategy advice, or work on assets you have built yourself.

2.7 Growth Accelerator

Growth Accelerator is an ongoing, done-for-you service for existing customers, which may include Meta (Facebook) advertising management and funnel optimisation. It is provided under a separate scope or agreement, billed as agreed between us, and is not sold through the public website. Fees for a given service period are non-refundable once work in that period has commenced.

3. User Conduct and Restrictions

3.1 Acceptable use

You agree to use the platform and services only for lawful purposes and in a way that does not violate any applicable laws or regulations, infringe the rights of others, disrupt or interfere with the functionality, security, or integrity of our platform, or attempt to gain unauthorised access to any part of the system or to other users’ data.

3.2 Prohibited use

You may not use the platform or services to send spam, scams, or unsolicited messages; to misrepresent your identity or impersonate another individual or organisation; to distribute viruses, malware, or other harmful content; or to engage in any activity that damages our reputation, services, or platform.

3.3 Account access and security

You are responsible for keeping your login details confidential. You must not share your account outside your organisation unless your plan permits it. You agree to notify us immediately of any unauthorised use of your account. We may suspend or terminate access where we reasonably believe these Terms have been breached.

3.4 No resale or redistribution

You may not resell, license, or redistribute access to the platform, templates, AI tools, or other assets without our explicit written consent.

4. Intellectual Property and Licensing

4.1 Ownership of materials

All content, templates, software, visuals, branding elements, automations, systems, AI tools, and documentation provided through the platform and services are the intellectual property of TakeFlight Digital Ltd, protected by copyright, trademark, and other applicable UK and international laws. You acquire no ownership rights by using or purchasing access to our services.

4.2 Personal licence to use

When you subscribe to a plan or purchase a digital product, you are granted a non-exclusive, non-transferable licence to use the product or service for your own individual or business use only. You may not reproduce, distribute, or share any part of the system outside your organisation; modify or repurpose templates or tools for resale; use our training materials, strategies, or frameworks to build or sell competing services; or extract source code, reverse-engineer, or attempt to replicate platform functionality for redistribution.

4.3 Your content

You retain ownership of any content, data, or materials you upload or create within your account. By using the platform, you grant us a limited licence to access and process your data solely to deliver and improve the services.

4.4 AI content

Our AI tools assist with content creation, but you are responsible for reviewing and approving any output before use. We are not liable for inaccuracies in, or misuse of, AI-generated content.

4.5 Brand and trademarks

All logos, product names, taglines, and visuals associated with TakeFlight are trademarks of TakeFlight Digital Ltd. You may not use our branding without written permission.

5. Disclaimers and Limitation of Liability

5.1 No guarantee of results

We provide tools, training, and services to support the growth and efficiency of property professionals, but we make no guarantee as to the specific results, outcomes, or business performance you may achieve. Results vary depending on your implementation, market conditions, business model, and effort.

5.2 Platform access and downtime

While we work to maintain high uptime and performance, we do not guarantee uninterrupted access. We are not liable for planned or unplanned maintenance, third-party service outages (for example email or SMS providers), or interruptions caused by internet or hosting issues. We will make reasonable efforts to notify users of significant disruption.

5.3 Limitation of liability

To the fullest extent permitted by law, TakeFlight Digital Ltd and its directors, employees, and partners shall not be liable for any indirect, incidental, or consequential damages; loss of business, revenue, or data; or claims arising from user error, misuse, or unauthorised access. In any event, our total liability shall not exceed the total amount you paid us in the twelve months preceding the claim.

5.4 Third-party integrations

The platform may integrate with third-party tools and services. We are not responsible for the functionality, availability, or data handling of those external platforms, and your use of them is subject to their own terms.

5.5 No professional advice and no guaranteed results

Nothing on our website or in our services constitutes legal, financial, tax, or other professional advice, and no earnings, revenue, or results are guaranteed. Property sourcing and investment carry financial and regulatory risk. You should consult your own qualified advisers before making business or investment decisions. Any testimonials or examples we share are not typical and are provided for illustration only.

6. Data Protection and Privacy

We process personal data in line with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Full detail of what we collect, how we use it, and your rights is set out in our Privacy Policy. Where you upload or manage customer or client data inside your account, you are the data controller for that data and are responsible for your own GDPR compliance; we act as a data processor and handle it solely to deliver our services.

7. Governing Law, Changes and Contact

7.1 Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

7.2 Changes to these Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business operations. Updates will be posted on this page with a revised “Last updated” date. Continued use of the platform or services after an update constitutes acceptance of the revised Terms.
